Terms and conditions for purchasing products

Your purchase of BRAND'S products from Suntory Beverage & Food Trading (Thailand) Co., Ltd. ("Brand") on this website is subject to the terms and conditions herein. By making a purchase from this website, you agree to be bound by and accept the following terms and conditions.
  1. The terms specified under this agreement and these conditions shall have the following meanings.
  2. g"Our," "we," and "us" refer to the brand.

  3. Only individuals aged 20 years and above can purchase products from the website.

By placing an order through this website, you are making an offer to us to purchase the goods you have selected on the website in accordance with these terms and conditions.
  6. We will make reasonable efforts to ensure that the prices and other details of the products displayed on the website are accurate. However, we reserve the right to change the prices and other details of such products without prior notice, and we shall not be liable or responsible in any way for any errors in the prices of the products displayed on the website. We also reserve the right to refuse orders that reference such pricing errors. The prices displayed on this website are for purchases made through the website only, and the prices of the same products may differ when purchased through other sales channels. Furthermore, the prices displayed on this website are applicable and valid only for deliveries within Thailand.
  7. The photos and images displayed on the website are provided to help indicate the characteristics of the product and may not resemble the actual product.
  8. By placing an order with us, you agree to accept our Privacy Policy and Terms of Use. You authorize us to collect, process, disclose, and use the information gathered from you for the purpose of processing your order, delivering products, and for the purposes specified in the personal data.
  9. If you have not yet joined the brand club, it is considered that you agree to become a member of the brand club from the first purchase on the website.
  10. The purchase of goods via credit card for products ordered through a credit card will be considered accepted by us only when the company has received full and complete payment for the ordered products, and you have received an electronic letter from our company detailing your order (“Payment Confirmation”).
  11. For orders placed through electronic banking, your order will be considered accepted by us only when the company has received full and complete payment for the ordered products, and you have received an electronic letter from our company and the payment processing company, which is an external party to the contract, detailing your order and confirming that payment has been received in the amount requested ("Payment Confirmation").
  12. When choosing to pay at the counter service, if you opt to pay for the goods through the counter service, you will receive an electronic letter from our company (“Notification”) and an electronic letter from the payment processing company, detailing your order. Receiving the notification does not constitute acceptance of your purchase order. Your order will be considered accepted by us only when the company has received full and complete payment for the ordered goods and you have received an electronic letter from the payment processing company, which is an external party, detailing your order and confirming that payment has been received in the requested amount (“Payment Confirmation”).

  13. Payment

    (g)Payment by credit card – You will be redirected to an external website of the credit card company, which is a third-party contractor, to process your payment. Your payment through that website constitutes your agreement to be bound by the terms and conditions of the credit card company and the terms and conditions of that external website.
    (B)Payment via electronic banking – You will be redirected to an external website of the payment processing company, which is a third-party contractor, to complete your payment. Your payment through that website constitutes your agreement to be bound by the terms and conditions of the payment processing company and the terms and conditions of that external website.
    (C)Payment at the Counter Service – You must pay the full amount for the goods as charged at the Counter Service within 48 hours from the time you are notified. Any order that is not paid within the specified time will be considered canceled. Payment at the Counter Service is deemed as your agreement to be bound by the terms and conditions of the company processing the payment.(D)You have been redirected to the external website of the payment processing company, which is a third-party contractor, to process your payment. Your payment through that website constitutes your agreement to be bound by the terms and conditions of the payment processing company and the terms and conditions of that external website.

    All payments are subject to the approval of the payment processing company, which is an external contractor, and/or financial institutions, and we will not be liable if the payment processing company, which is an external contractor, and/or financial institutions refuse to accept or verify the credit card or electronic banking transactions, or counter service transactions for any reason. We reserve the right to (1) exercise our sole discretion to refuse any payment without having to provide a reason for such refusal, and (2) change the payment terms for products at any time. All orders received through the website are subject to our order fulfillment. We may accept or may not accept your order at our discretion.

  14. The ownership of the goods and the risk of loss or damage to the goods you purchased will transfer to you immediately once the goods have been removed from our premises, provided that we have received full and complete payment for the ordered goods at all times.

  15. Product delivery

    (1)After confirming the payment, we will proceed to ship the goods to the address provided.
    (2)Shipping will be conducted only for locations situated in Thailand. However, we reserve the right to refuse to ship to any location without the need to provide a reason for that refusal.
    (3)Unless otherwise agreed upon by both parties, we will deliver the goods via a private transportation service to the address provided in your order submitted through the website.
    (4)Although we have made reasonable efforts to ensure that we can deliver the goods to you within 3-5 business days from the date you receive payment confirmation, we do not guarantee that we will be able to ship within this timeframe. The delivery dates we have provided are estimated and are not considered part of the contract between you and us. We are not liable for any delays that occur in the delivery of goods, regardless of the cause.
    (5)All products that are shipped and received at the address specified in your order will be considered as successfully delivered and the order completed. In the event that there is no recipient for the delivered goods, we may exercise discretion in reshipping the products, and you will be responsible for the shipping costs for the next delivery.
    (6)We recommend that you check the product as soon as it is delivered to you within 7 days from the date you receive the product. If you find that the product has been delivered incorrectly or if the product is damaged or defective, you can notify us for a return by contacting us at 02-079-7999. The product must be in good condition, unopened, and in a resalable condition.
    (7)In the event that any product is delivered incorrectly or is defective, you may request to return the product to us within 7 days from the date you received the product by calling us at 02-079-7999. Please note that the product must remain unopened and in good condition for resale. If more than 7 days have passed, we will not process your request.
    (8)In the event that the product is returned to us because it cannot be delivered, the order will be considered canceled, and we will refund the amount charged to you for the product.
  16. To the extent permitted by law and applicable regulations, our total liability for your orders placed through the website and for any other cases, whether under contract, tort, or otherwise (including but not limited to loss, damage, or injury arising directly or indirectly from products not conforming to the agreement, or any other breach of our obligations as stated herein), shall not exceed the total value paid for the purchase of goods. We shall not be liable to you for any direct, indirect, special, incidental, or consequential damages arising under or in connection with the purchase of goods (whether such liability arises from negligence, breach of contract, misrepresentation, or any other cause) or for any loss incurred by you from our employees, agents, or customer service representatives.
  17. You agree to indemnify and hold us harmless from any loss or damage to property, or injury to the body or life of any person, resulting from your negligence, intentional misconduct, or breach of contract as stated in this agreement and these terms and conditions.
  18. Your purchase of goods from this website is solely at your own risk. The products sold under this website are provided without any express or implied warranty, including but not limited to any implied warranties or conditions of merchantability, quality, fitness for a particular purpose, or non-infringement of applicable laws.
  19. This agreement and these terms and conditions represent all of our obligations and liabilities regarding your product orders through the website and related services, and there are no warranties, conditions, or other agreements that bind us, except as expressly stated in this agreement and these terms and conditions. Any warranties, conditions, or agreements regarding the products that may be considered part of this agreement and these terms and conditions by implication, by law, or otherwise, shall be deemed to be entirely excluded, to the fullest extent permitted by law.
  20. We reserve the right to modify, improve, and change this agreement and its terms and conditions at our discretion without prior notice to you. Your continued use of the website and submission of orders after such modifications will be deemed as your acceptance of the changes made to this agreement and its terms and conditions.
  21. We have no liability for any loss or damage you incur arising from delays in processing or inability to process, or for any other release from liability under this agreement, as long as the delay or inability to process is due to any circumstances beyond our control.
  22. You agree and acknowledge that the products purchased from this website are intended for personal use only. You will not sell or resell any products.
  23. We reserve the right to limit, cancel, or reduce the quantity of an order in the event that, in our sole discretion, the order may result in a violation of our terms and conditions or violate any applicable laws or regulations.
  24. If any of the terms and conditions of this agreement are not binding and enforceable under the law, or are contrary to the law for any reason, by a court with jurisdiction, such terms and conditions shall not affect the enforceability of the other terms and conditions, and the terms and conditions that cannot be enforced under the law shall be deemed to be severed.
  25. The terms and conditions of this agreement, including the notification and confirmation of payment, shall be considered a contract between both parties for the purchase of your goods and shall take precedence over any other statements or agreements, whether written or verbal, between you and us.
  26. The terms and conditions of this agreement shall be governed by and construed in accordance with the laws of Thailand. Any disputes arising under or in connection with the terms and conditions of this agreement, including without limitation any questions regarding its existence, validity, or termination, shall be referred to and finally resolved by the courts of general jurisdiction in Thailand.
